PAYMENT TERMS
An initial non refundable deposit which is taken by the booking service will be secured at the time of booking confirmation. Accepted credit cards are Visa and Mastercard (transaction fee of 1.75% applies).

The balance due will be secured prior to your arrival to pick up your vehicle. Please arrange to have the funds available on your nominated account a few days prior to pick up. Accepted credit cards include Visa, Mastercard (along with Amex and Diners Club which attract an additional 5.5% per transaction.)

CONDITIONS OF HIRE
The Rental Agreement is an agreement between the prospective hirer and the Company to rent the vehicle including all accessories, tools, tyres and equipment and any replacement vehicle (the vehicle).

VEHICLE CONDITION AND RETURN

The vehicle is delivered to the hirer in good operating condition with the seal of the odometer unbroken.The hirer agrees to return the vehicle in the same condition (except for ordinary wear and tear NOT INCLUDING WINDSCREEN OR TYRE DAMAGE) together with all tools, tyres, accessories and equipment to the location and on the date specified (or sooner, if demanded by the Company) on the Rental Agreement. The Company may take possession of the vehicle without prior demand and at the hirers expense, if it is illegally parked, used in violation of the law or of the agreement or if it is apparently abandoned. If the seal of the odometer is broken the person responsible will be reported to the appropriate authority and the hirer is responsible for extra charges based on 100 kilometres per day at 50c per kilometre.

Note: The company must be notified and agree to any extension of the period of hire beyond that stated on the agreement in advance of the return date and time or the vehicle will be immediately reported as stolen.

UNAUTHORISED AND PROHIBITED USE
Persons who must not drive the vehicle
(a) A person who is not identified on the agreement or has not been identified in writing to the company or approved by the company in writing.
(b) A person who is not licensed for that class of vehicle.
(c) A person whose blood alcohol concentration exceeds the lawful percentage.
(d) A person who has given or for whom the hirer has given a false name, age, address or drivers license details.
(e) A person whose drivers license has been cancelled, endorsed or suspended within the last three years.
(f) A person who has held a drivers license for less than two years.

CIRCUMSTANCES IN WHICH AND/OR FOR WHICH THE VEHICLE MUST NOT BE USED:

(g) Outside the area of use limitations shown on the agreement.
(h) On unsealed roads or off road conditions unless authorised by the company in writing or the face of the agreement.
(i) To carry persons for hire or to carry any inflammable, explosive or corrosive materials.
(j) To propel or tow any vehicle, trailer, boat or other object unless the company has authorised such use in writing.
(k) To carry any greater load and/or more persons than is lawful or use in a manner or for a purpose other than for which it was designed and constructed.
(l) For racing, pacemaking, reliability trials, speed trials, hill climbing or being tested in preparation for those purposes.
(m) In a dangerous manner.
(n) In contravention of any legislation or regulation controlling vehicular traffic or for any illegal purpose.

INSURANCES

All vehicles are insured. The hirer is given the benefit of this coverage subject to the conditions of hire. The insurance excess (deductible) on our vehicles is AUD2750.00 (or AUD5000.00 for the Mercedes) NB: the excess may vary for single vehicle accidents or by driver age (as outlined below). This means if the vehicle is damaged while rented by you, you will be liable for this cost . You can cover yourself against this outcome by taking out excess reduction cover (Collision Damage Waiver).

Single Vehicle Accidents incur the excess of $3300.00 regardless of whether a Collision Damage Waiver has been selected and regardless of age.

COLLISION DAMAGE WAIVER - OPTION 1 (Driver's Aged 25+)
Your liability may be reduced from AUD2750.00 to AUD550.00 by paying an additional charge of $22.00 per day*. This collision damage waiver (CDW) is optional and does not negate the need to pay the standard bond of $200 on collection of the vehicle by way of a pre-authorisation on your credit card.

*NB: This supplier has no Collision Damage Waiver Option for the Mercedes and therefore full liability of $5000 will apply.

Single Vehicle Accidents incur the excess of $3300.00 regardless of whether a Collision Damage Waiver has been selected and regardless of age.

COLLISION DAMAGE WAIVER - OPTION 2 (Driver's Aged 21-24)
Your liability may be reduced from AUD2750.00 to AUD1100.00 by paying an additional charge of $22.00 per day*. This collision damage waiver (CDW) is optional and the Supplier is approved to secure $200.00 as a bond on collection of the vehicle by way of a pre-authorisation on your credit card.

*NB: This supplier has no Collision Damage Waiver Option for the Mercedes and therefore full liability of $5000 will apply.

Single Vehicle Accidents incur the excess of $3300.00 regardless of whether a Collision Damage Waiver has been selected and regardless of age.

FINANCIAL OBLIGATIONS
Special Note: Joint hirers and all drivers are jointly responsible under the agreement.
The hirer is responsible at all times and will pay the company by allowing and authorising the company to debit their credit card/deposit for the balance of the following charges:
(a) All rental charges specified on the agreement.
(b) All charges claimed from the company in respect of parking or any other traffic violations incurred during the period of hire or until such later time as the vehicle is returned to the company.
(c) All loss or damage to the motor vehicle (including loss of use), third party damages, legal expenses, assessment fees, towing and recovery, storage and company service charges where
(i) any condition of the agreement or any special condition on the agreement has been breached.
(ii) the vehicle is involved in a single vehicle accident unless the Company waives such loss to a single vehicle liability amount shown on the agreement.
(iii) the hirer has left the vehicle unlocked or left the keys in the vehicle.
(iv) the hirer has not kept the key secure.
(v) the underbody of the vehicle is damaged regardless of cause when no other vehicle is involved.
(vi) the vehicle is totally or partially immersed in water regardless of cause.
(vii) the interior of the vehicle is damaged regardless of cause when no other vehicle is involved.
(viii) the tyres of the vehicle are damaged other than by normal wear.
(ix) the vehicle is damaged by driving it under or into an object lower than the height of the vehicle.
(x) the hirer has failed to maintain all fluid and fuel levels or failed to immediately rectify or report, to the company any defect of which the hirer becomes aware
(xi) the vehicle is damaged by loading or unloading, other than normal wear
(xii) the hirer fails to secure properly any load or equipment which leads to loss caused by any part of said load or equipment

Special note: If the hirer has paid by use of a credit card or directed the company to bill charges to some other person, corporation, firm or organisation who or which fails to make payment when due, the hirer will immediately pay the full amount due to the company on demand.

DAMAGE COVER
If the hirer acts within the terms and conditions of this agreement the company may grant damage cover (including legal costs incurred with the company's consent) for hirers benefit in respect of damages to the vehicle or third party damage other than any property owned by the hirer (or any friend, relative, associate or passenger) or in the hirers physical or legal control. This cover is subject to:
(a) hirers payment of the damage/loss liability charge stated on the agreement.
(b) hirer not having acted or having caused any other person to have acted in any manner which is in contravention of the agreement including the special conditions .
(c) hirer not being covered under any policy of insurance.
(d) hirer providing such information and assistance as may be requested and, if necessary, authorising the company insurer to bring, defend or settle legal proceedings, but the company shall have sole conduct of the proceedings.

GENERAL PROVISIONS

(a) Hirer will promptly report any incident involving loss or damage to the vehicle or loss involving the vehicle while rented under the agreement to the company location where the vehicle was hired and will deliver to the company immediately, every summons, complaint or paper in relation to such loss.

Compliance with this sub-paragraph does not excuse the hirer from reporting all incidents to police or other proper authorities.

(b) Hirer releases and holds harmless the company (and its agents and employees) from all claims for loss or damages to their personal property, or that of any other person left in the vehicle, which is received handled or stored by the company at any time before, during or after this rental period, whether due to the company's negligence or otherwise.
(c) Except as provided by law no driver or passengers in the vehicle shall be or deemed to be the agent, servant or employee in any manner for any purpose whatsoever.
(d) The company gives no express or implied warranty as to any matter whatsoever including without limitation the condition of the vehicle and equipment, its merchantibility or fitness for any particular purpose.
(e) No right of the company under this agreement may be waived except in writing by an officer of the company.
(f) Words used in the agreement to denote any gender shall include all genders, singular words include the plural, and noted on the agreement.

FUEL
The vehicle must be returned with the amount of fuel equal to that at the time of the rental. If the vehicle is returned with less fuel the difference will be charged at a rate which may include a service component unless prior arrangements have been made and noted on the Rental Agreement.

PRICING
Rates quoted on web site are based on cash payment in advance, limited supply available and KM restrictions apply.

AFTER HOURS PICK UP AND DROP OFF

A surcharge of  AUD33.00 will apply to after hours collections or returns at our airport locations (between 11pm and 5am). If both pick-up and drop-off are out of office hours a surcharge of $66.00 will apply.

A surcharge of AUD22.00 applies to after hours collections or returns at our Melbourne location (Mon-Fri between 6pm and 8am / Sat-Sun 3pm and 8am). If both pick up and drop off are outside of office hours a surcharge of $44.00 will apply.

LATE COLLECTION/RETURN SURCHARGE
If the vehicle is not collected or returned at the time allocated, or Advance has not been notified 24 hours prior, there will be an AUD50.00 fee added to the rental per day plus an AUD22.00 per hour surcharge applied for every hour until vehicle is collected or returned.

EARLY RETURNS
There will be no refunds given for the early return of rental vehicles.

PUBLIC HOLIDAY SURCHARGE
Public Holiday Surcharge $72.50 will be applied for pick up or drop off on 25th, 26th or 28th December.
Public Holiday Surcharge $55.00 will be applied for pick up or drop off on 26th Jan, 8th March and 2nd, 3rd, 5th, 26th Apr, 2010.

LIMITED KILOMETRES
Please note that 100kms per day only are included in the base rental price of your booking for all vehicles. Additional kilometres will be charged as below:

Holden Commodore - 22c per additional kilometre
Mitsubishi Outlander - 22c per additional kilometre
Toyota Commuter - 22c per additional kilometre
Toyota HiAce - 22c per additional kilometre
Toyota Tarago - 22c per additional kilometre
Hyundai Getz  - 22c per additional kilometre
Toyota Corolla - 22c per additional kilometre
Toyota Camry - 22c per additional kilometre

Mercedes Benz CLK 320 - 89c per additional kilometre

CANCELLATION TERMS
Note: The initial deposit is non-refundable. Along with the deposit the following charges will apply:
If cancelled within 31 days of pick-up: $50.00 fee
If cancelled within 10 days of pick-up: 50% of the total cost of rental
If cancelled on the day of pick-up or non-appearance: No refund on total cost of rental.
There is no refund for late pick up or early return of vehicle.

While we will make reasonable efforts to ensure we are representing only reputable suppliers, we make no warranty about the fitness or suitability of any third party (supplier) product or service and will not accept responsibility for the quality or fitness of any vehicle. We welcome feedback from our customers on their experience with our suppliers. We may, at our discretion, provide you with reasonable assistance in resolving any dispute you may have with a supplier.

Our total liability to you in relation to your use of this website and the information contained on this website will not exceed the dollar amount of the deposit we have received from you in relation to your booking/rental. Refunds will not be made for bookings cancelled due to inclement weather. Again, we strongly recommend that you take out travel insurance. Your use of this website is governed by the laws of New Zealand and the jurisdiction of the New Zealand courts.

Once we receive your form, we will, subject to availability, confirm your booking by emailing you a confirmation voucher and invoice. Please note that a 1.75% credit card charge will be added when your payment is processed.

A booking is confirmed when you have been emailed a confirmation voucher and at this stage the deposit is processed on your card and becomes non-refundable and any cancellation fees stated in the supplier's terms apply. Upon receipt of your confirmation, please check your details carefully and notify us immediately if there are any incorrect details, as it may not be possible to make changes at a later date.

If you are booking via phone, please make sure you have read the terms and conditions of the vehicle you wish to rent first. Our reservations consultant will ask you if you have read the terms and agree to them before proceeding. The onus is always on the renter to ensure they make themselves fully aware of the terms displayed on our website.

To add or remove extras to/from a confirmed booking: 10.00

The alteration fee will not be charged if your alteration request is not possible.

A vehicle supplier can refuse to rent a vehicle to any person who is in their opinion unfit to drive or does not meet eligibility requirements. In such circumstances we will have no further liability to you.
